The conveyancing team at Legal Solutions is made up of friendly and experienced lawyers and conveyancing clerks who will work for you to ensure your sale or purchase runs smoothly.

As we are a law firm, if legal issues arise at any point during the transaction, we have the resources and knowledge to resolve those issues, including, where necessary, representing your interests in court.

What is Conveyancing?

Upon your first appointment, we will be able to give you reliable advice about your legal rights, entitlements, and obligations. Often, that advice can determine whether your decision to separate is a permanent one or whether you decide to separate from your partner at all. We can assist you in responding to a Court Application or demands from your ex-partner’s lawyer.

Pre-Contractual Legal Advice

Legal Solutions will happily assist you prior to signing an offer by reviewing your Contract to ensure that your interests are protected and providing advice to you about additional clauses you may require. We will also explain the terms of the Contract to you and answer any other questions you may have about the transaction.

We strongly recommend that you contact us prior to signing a Contract as we do not have Vendor Disclosure laws in Tasmania, and therefore, you are purchasing the property on an “as is, where is” basis unless your Contract provides otherwise.

Now You Have Signed The Contract, What Do You Do Next?

Contact the friendly Conveyancing Team at Legal Solutions to commence the conveyancing process if you have not already done so.

If you have already engaged us, please have your agent nominate Legal Solutions as your Solicitor, and they will then forward us a copy of the signed Contract.

Conveyancing Process

During the conveyancing process, we will keep you informed on a regular basis as to the progress of your transaction. It is important to us that we communicate all aspects of your transaction to you to ensure that your sale or purchase runs smoothly, and in the event that any issues arise, they are dealt with efficiently and quickly.

As a part of our service, we will undertake all due diligence and other required searches of the property and report their findings to you.

We will liaise with your lender and prepare all documentation on your behalf that is required to effect settlement.

We will also liaise with the other parties’ legal representatives and your real estate agent throughout the process. We will attend to the settlement on your behalf and advise you and the agent once the transaction has been settled.

Buying

Referrals

During the conveyancing process, we are happy to refer you to trusted and qualified professionals that you may require advice or assistance from to complete your Contract, including:

  • Building inspectors
  • Surveyors
  • Financial advice
  • Insurance advice

Finance

If you are borrowing money from a lender, you only have the time provided in the Contract to obtain unconditional approval. You should take a copy of your signed Contract to your banker or broker as soon as possible.

Insurance

As soon as you sign the Contract, telephone your insurer and obtain a cover note on the property. Even before you settle the Contract, you can be liable for the cost of damage to the property.

Power and Phone

Arrange for your power and phone to be connected on the settlement date. We also recommend you make enquiries with Dial Before You Dig to obtain information as to any cables running underneath the property.

Mail

You are required by law to change the address on your driver’s licence and the Electoral Role as soon as you move! If you notify the Department of Transport, they can update your address on your vehicle registration. Don’t forget your doctor, Medicare, Bank, Council pet registrations and Superannuation.

Pre-Settlement Inspection

We recommend you arrange a final inspection of the property with the agent to ensure the property is still in the same condition as when you signed the Contract.

Selling

Insurance

Do not let your insurance lapse prior to settlement, as you are liable for any damage to the property until settlement has been completed.

Power and Phone

Arrange for your power and phone to be disconnected on the settlement date.

Mail

Keys

You should locate all houses, sheds, garages, and other keys relating to the property and label them. Prior to settlement, ensure that you have provided all of your keys to the agent or Legal Solutions so they are available to the Purchaser once settlement has been completed.

Costs

In Tasmania, there is no Vendor disclosure and therefore, the onus is on the Purchaser to carry out all due diligence enquiries about the property prior to settlement. There are a number of searches that we ordinarily undertake on behalf of our clients in land or residential transactions to ensure your interests are protected. Duty and First Home Owner Grants

Our conveyancing team can assist you in determining the amount of government stamp duty and fees you are required to pay on the transfer of a property you are purchasing.

Our team can also assist clients in relation to their eligibility and requirements for receipt of the First Home Owners Grant.
